 Disclaimer: This article talks about rape. I believe that if anyone is raped by someone else that the rapist deserves to be punished equally to that of murder and that “she asked for it or she was dressed provocatively” is not a valid excuse for rape. If after you read this article you think I am advocating rape as a good thing, tough. That is not what I am saying and I ask you to read this article from the viewpoint of protecting the rights of the accused and the fact that the constitution guarantees equal protection under the law.

Women, you go to the bar and have a couple of drinks with your date. You are both a little buzzed, but are having a good time so you go back to your place and end up sleeping together. Now did you ever ask yourself if the guy was too drunk to have consented, that he wasn’t too intoxicated to consent to sex? Of course not, but the guy should have. According to several judges in America, he just raped you.

Sounds crazy right? But there is legal precedence in several says that even one beer or drink interferes with a woman’s ability to consent and that she could indeed be raped. The judge that made the ruling said it was the guy’s responsibility to make sure the woman is in no position to be taken advantage of.

So after forty years of fighting for the vote, fighting to be able to work in any field they want, and fighting for equality, now it seems women are fighting to be free of responsibility. That’s what the ruling said to me. Men are responsible for making sure nothing bad happens and it’s all on them if they didn’t follow the checklist fully.

How many beers does it take before a man can consent? According to law, a man always consents. Right now, a man and a woman could go a party, both get drunk, sleep together and not remember it the next morning, and even if the guy felt violated, he was the rapist according to the law. So much for equal protection.

I am not advocating that if a woman goes to a party and gets drunk she should be expected to be raped. I am arguing that if a man and a woman go to a party or even go out to dinner, the guy shouldn’t have to check her breath, make sure she isn’t mentally unstable, check that she didn’t secretly smoke some hash, or any of the dozens of things he has to check or he can get into serious trouble. All I am saying is, if a woman doesn’t have to fill out the checklist, a man shouldn’t have to either.

Woman, you can go to the party and have a good time and shouldn’t have to be afraid for your well-being. Just don’t make the guys the ones responsible for you.
